STATEN ISLAND, N.Y. — A Midland Beach man who allegedly went berserk at a local Applebee’s in April had already pleaded guilty in a similar case, court records show.
Tylor Westcott, 27, of Lincoln Avenue, is facing felony assault charges in connection with the April 19 arrest in which he allegedly injured staff and a first responder at Applebee’s in New Dorp.
At his arraignment two days later, Judge John McPadden ordered he be remanded without bail. At the time, the defendant already had an open case in Criminal Court.
In March, Westcott pleaded guilty to petit larceny in connection with a Nov. 16, 2024, incident, court records indicate. He was facing other charges in that case including assault, harassment and criminal possession of stolen property.
Both cases were adjourned to June 18 before Judge Raja Rajeswari. The defendant’s attorney, a public defender with the Legal Aid Society, did not respond to a request for comment.
Alleged melee involved staff, diners
The Applebee’s incident, according to a criminal complaint, unfolded around 10 p.m. on Saturday, April 19, inside the location at 2636 Hylan Blvd.
Westcott became irate while watching a sporting event and smashed his plate onto the floor, court documents alleged.
Staff members, all under the age of 25, told him to leave and offered to forego payment on his bill — but things were only getting started, according to a criminal complaint.
As staff tried to escort him out, he allegedly slapped a male employee and a female employee. Then, he walked back to his table, grabbed a cup and threw it in the direction of staff members, according to the complaint.
The fracas spilled into the vestibule, where Westcott — who is listed in jail records at 5-feet-9-inches-tall and 180 pounds— allegedly punched a female employee in the face and another female employee in the shoulder.
In the parking lot, he shoved a female worker in the chest, causing the victim to fall backward and strike the back of her head on the bumper of a vehicle parked at the location, the complaint alleges.
The male employee and three customers held Westcott on the ground for approximately two minutes until police arrived, a law-enforcement source said at the time.
Staff injured in the fracas included a 19-year-old man, a 21-year-old woman and two 24-year-old women.
Westcott, who was deemed emotionally disturbed and taken to Richmond University Medical Center in West Brighton, then kicked the arm of a male EMT who was trying to take him out of the ambulance, the complaint stated.
